1. DEFINITIONS

Each of the terms mentioned below will have in these General Terms of Sale of the Service Annoncepopulaire (referred to as the "CGV") the following meaning :

announcement :

Designates all elements and data (visual, textual, sound, photographs, drawings), filed by an Advertiser under its exclusive editorial responsibility, for the purpose of buying, renting or selling a property or service and disseminated on the Website and Applications.

advertiser :

Designates any individual, major, acting exclusively for private and non-professional purposes (any Professional Advertiser is obliged to open a Pro Account and respect the CGVs applicable to holders of a "Pro Account"), established in France (includes DOMs excluding Mayotte), holder of a Personal Account and having filed an Advertisement, from it, on the Website, and/or on the Applications. It is imperative that all Advertisers be connected to their Personal Account to deposit and manage their ads. Any first ad filing automatically results in the creation of an Advertiser-specific Personal Account.

Applications :

Designates the Android app that can be downloaded for free on an Android phone from the Google Play Store, and the app optimized for iPhone and iPad that can be downloaded from the Apple App Store for free on an iPhone or iPad with a minimum, iOS 7 for iPhone, or iOS 8 for iPad, allowing Users and Advertisers to access the Service Annoncepopulaire section 3.1 of the GU available here.

Personal account :

Designates the free space that every Advertiser must create and connect to from the Website and Applications, in order to run, manage, view ads, subscribe to one or more paid options and purchase credits.

Annoncepopulaire :

Designates the company that edits and operates the Website and Applications Annoncepopulaire.

customer service :

Denotes the service of Annoncepopulaire advertiser can obtain any additional information from the Advertiser. This service can be contacted by email by clicking on the link on the Website and Applications.

Service Annoncepopulaire :

Designates services Annoncepopulaire made available to Users and Advertisers on the Website and Applications as described in Section 3.1 of accessible CGUs ici.

website :

Designates the website operated by Annoncepopulaire accessible primarily from the URL www.annoncepopulaire.com and allowing Users and Advertisers to access the Service via the internet as described in Article 3.1 of the accessible CGUs ici.

Utilisateur :

Designates any visitor, having access to the Service d'Annoncepopulaire via the Website and/or Applications and consulting the Service accessible from the various media.

2. object

Les présentes Conditions Générales de Vente (CGV) établissent les conditions contractuelles applicables à toute souscription, par un Annonceur connecté à son Compte Personnel, d'option(s) payante(s) et d’achat de crédits depuis le Site Internet et les Applications.

3. acceptance

Any subscription of paid options and/or purchases of credits by an Advertiser is worth full acceptance of existing GVCs.

4. TERMS OF SUBSCRIPTION TO PAID OPTIONS AND A PURCHASE OF CREDITS

4.1 General rules

4.1.1 Paid options

The subscription of one or more paid options is exclusively available to Advertisers connected to their Personal Account from the Website and/or Applications.
A paid option is only subscribed for one ad. As a result, it is not possible to transfer the benefit of a paid option from one ad to another.
It is possible to subscribe to several paid options for the same ad simultaneously or not.
The price of each paid option varies depending on the type of option subscribed and the deposit category selected. The price schedule for paid options by category is present in the article 6.
The Advertiser recognizes and accepts that any Advertisement filed in a category that does not correspond to the proposed product or service may be removed at any time, by ADPOPULAR, without compensation or the right to refund the sums incurred for the purpose of underwriting to pay options..
Ads are ranked on the Service ANNONCEPOPULAIRE chronologically, depending on the date and time of their posting. As a result, any Advertiser recognizes and accepts that the presence at the top of the list of its ad is only temporary.

4.1.2 Buying credits

The purchase of credits is made exclusively from the Advertiser's Personal Account.
Credits purchased allow you to subscribe to one or more of the paid options as described in Article 5 of these Terms of Sale.
Credits are attached to the Personal Account from which they were purchased and cannot be transferred to another Personal Account.

4.2 Space and Subscription Moment

4.2.1 Paid options

Paid options can be subscribed, by any Advertiser connected to their Personal Account, from the Website and Applications :
- either from the filing form when filing, amending or extending a Annonce,at any time during the broadcast of an Ad, - either from the Dashboard of the Advertiser's Personal Account,
- from the Ad page, via the "Put Forward" button ».

The Supplemental Photos Pack can only be subscribed when an ad is filed, amended, or extended.

The Booster Pack can only be subscribed during the broadcast of an Ad, from the Personal Account dashboard.

Advertisers are not available to subscribe to Additional Photo Packs, Vacation Rentals, and Booster from Apps.

4.2.2 Buying credits

Any Advertiser connected to their Personal Account can subscribe to an offer to purchase credits described in Article 6 of these Terms of Sale from the "My Purchases" tab..
The purchase of credit cannot be made at the time of filing an advertisement or signing up for one or more paid options (s).

4.3 Duration and effect of paid options and credits

4.3.1 Paid options

With the exception of paid options :
« Holiday Rental Pack" underwritten for 6 (six) months, « Booster Pack" subscribed for 1 or 3 months, « To top the list every day for 7 days" and « A la Un 7 jours" subscribed for a period of seven days, « To get back to the top of the list every day for 1 month" and « A la Un 30 jours" underwritten for a period of 30 consecutive days and « Go back to the top of the list immediately" valid once at the time of subscription,

any other paid option is subscribed for the duration of the Ad non-extension :
- for up to sixty (60) days if it is subscribed at the time of filing the Advertisement,
- for a duration of less than sixty (60) days and equal to the validity of the remaining ad to run if it is subscribed during the broadcast of the Advertisement.

With the exception of the subscription to the paid "Holiday Rental Pack" option, the subscription of a paid option does not extend the duration of the ad.

When the Advertisement is withdrawn early (either as a result of the Advertiser or because of the Annoncepopulaire (particularly in the case of abusive content) or when its broadcast period expires, the paid option ceases to produce its effects. Extending an Ad does not extend the duration of the paid option.

Changing a Personal Account does not extend the duration of paid options(s) subscribed).
The deletion of a Personal Account results in the removal of all Advertisements attached to that account (same email address) and, as a result, any paid options subscribed for these Ads and does not give any right to refund or compensation, which the Advertiser recognizes and accepts..

4.3.2 Credits

Each credit purchased has a validity period of 12 months, which runs from the day of purchase.
However, any new purchase of credits results in a new 12-month validity period for all valid Advertiser credits, effective from the date of the new purchase of credits..

As a result, any credit not consumed before the end of its 12-month validity period will be removed from the Advertiser's Personal Account, without the possibility of refund or compensation, if during this period of validity, the Advertiser has not made a new purchase of credits, which the Advertiser recognizes and accepts..

No extension of the validity of a credit may be requested from Annoncepopulaire.
The deletion of a Personal Account results in the removal of credits associated with that account.

5. DESCRIPTION OF PAID OPTIONS

5.1 Changing the Ad

This option allows you to change certain fields in your ad :
- Your name
- Your phone number
- The title of your ad
- Category-specific parameters (model-year, mileage, cylinders, … )
- The description
- The price
- The photos
- The postcode
- The name of the city

Without this creating an obligation to verify the content, Annoncepopulaire reserves the right to refuse or remove any ad that has been changed by the Advertiser who does not comply with the Service's broadcasting rules Annoncepopulaire . In the event of a refusal by Annoncepopulaire to broadcast the modified ad, an email informing the Advertiser of the refusal will be sent to him.

If the Modified Ad is published, it will be immediately toped on the Website and Applications.

5.2 Putting my Ad back to the top of the list

This paid option comes in four forms :

5.2.1 Get back to the top of the list immediately

The ad will be put back at the top of the results list, on the Website and Applications, as if it had just been put online.

5.2.2 Top of the list every day for 7 days

The ad will be reassembled at the top of the list, on the Website and Applications, every day for 7 consecutive days on the anniversary of the subscription to the option, during its period of online.
An email will be sent to the Advertiser to confirm the subscription of the option and another will be sent to him the day after the expiry of the option, the 8th day, to inform him.

5.2.3 Top of the list every day for 30 days

The ad will be reassembled at the top of the list, on the Website, and the Applications, every day for 30 days, counting :
- The day after the ad is filed, amended or extended, if the subscription to this option is made at the time of the filing of the Advertisement, amendment or extension,
- Subscription to this option if it does not take place on the day of the filing of the Advertisement, but during its period of online.

If the ad's time before it is removed is strictly less than 7 days, the Advertiser will not be able to subscribe to the option.

An email will be sent to the Advertiser to confirm the subscription of the option, another email will be sent to him on the 8th, 15th and 22nd days of the subscription to remind him that his ad is back at the top of the list every day. Finally, a final email will be sent to him the day before the expiry of the option, the 29th day after the subscription to the option, in order to inform him.

5.2.4 Top of the list each week for the life of the Ad

The Ad will be placed at the top of the list, on the Website and Applications, each week on the anniversary of the ad filing, throughout its validity period.
An email will be sent to the Advertiser each time the Advertiser is raised at the top of the list.

5.3 Add an Urgent Logo

This option allows you to display an urgent logo on an Ad.

5.4 Put my ad on the front page

This option allows you to show an Ad in a separate location from the other Ads to the right of the Website's results list that matches the search criteria for the property. This location is identified by a "On the Front" logo. The Ad will be highlighted to the maximum with two other announcements. Ads with the "A la's" option will be displayed randomly, so an ad will not be permanently visible on the Website.

The Advertiser is informed that due to the ergonomics of the solutions, the "On the Front" Ads will not be visible from the iOS Mobile App, which the Advertiser recognizes and accepts.

The Advertisement must have at least one photo, offer an offer of property (not an application) and not be filed in any of the following categories: Employment, Box Office, Events and Individual Courses.
If the life of the Ad before it is removed is strictly less than 7 days, the Advertiser will only be able to subscribe to the option for a period of 7 days.

As soon as the term of the "A la's" option is over, an email will be sent to the Advertiser to propose a new broadcast of the Ad with the option "A la Une ».

5.5 Additional Photos Pack

This option allows you to add seven (7) additional photographs in an Ad and present a maximum of ten (10) photographs in an Ad.

This option can only be subscribed from the Website when filing, amending or extending the Advertisement.

If the Ad is published by Annoncepopulaire, it will be released with additional photos on the Website and Applications.

5.6 Holiday Rental Pack

This option allows you to:
- Broadcast an Announcement of Offer in the Holidays Family for 6 (six) months from the date of subscription to this option (instead of the usual 2 months ).
- Present a maximum of ten (10) photographs in a Family Offer Announcement holiday.
- Change the Holiday Family's Offer Announcement for the duration of its validity and up to 6 months from the "Holiday Rental Package" subscription. (Given that the Modified Vacations Family Offer Announcement will always have to deal with the same property, failing that Annoncepopulaire reserves the right to remove any amended Advertisement that does not comply with this condition). It should be noted that the modification of the "Holiday Rental Pack" ad will not result in an immediate rise to the top of the list..
- To give the Holiday Family an offer announcement of an automatic weekly list tops the list for the duration of its validity and within the 6 months of the subscription of the "Holiday Rental Pack" ».

This option can only be subscribed, from the Website, as part of a Holiday Family Offer Announcement. Holiday rental application announcements are not affected.

IIt is important to note that if the "Holiday Rental Pack" option is subscribed as part of a change to the Ad, the ad change fee will also be due.

If the Advertiser subscribes to the "Holiday Rental Pack" option for an ad in the run that it has already subscribed to other paid options, the previously subscribed options will be treated as follows :

The "Logo Urgent" option will be transferred within the "Holiday Rental Pack" and the Advertiser will benefit from it for the duration of its ad and within 6 months of the subscription of the "Holiday Rental Pack" ».

the "Up to the top of the weekly list" option will be replaced (with no possibility of refund) by the "Uplift to the top of the weekly list" option in the "Holiday Rental Pack". As a result, the Ad will be toped each week on the 'anniversary' date of the subscription to the option 'Holiday Rental Pack' ».

the option "Up to the top of the list for 7 or 30 days" will be active until its expiration (7 or 30 days) in parallel with the "Holiday Rental Pack" ».

The "Additional Photos Pack" option will be replaced (without possibility of refund) by the additional photo offer of the "Holiday Rental Pack" allowing to present up to 10 photos per ad. Additional photos already in the Ad will be transferred to the Holiday Rental Pack ».

After signing up for a "Holiday Rental Pack," the Advertiser retains the option to subscribe to the following paid options :
« On the front page": 7 or 30 days, an option that will be active until it expires (7 or 30 days) in parallel with the "Holiday Rental Pack" »
« Immediate top of the list »
« "Urgent logo" which will be affixed to the Advertisement for the duration of the validity and within a limit of 6 months from the subscription of the "Holiday Rental Pack" »

If the Ad is published by Annoncepopulaire, it will be broadcast on the Website and Applications.

5.7 Pack Booster

The Booster Pack allows the Advertiser to benefit, for its Ads, for the selected duration and within the proposed tier:
- A top-of-the-list climb every 14 days depending on the date and time the Ad goes online;br> - Free and unlimited change
- From the "Pack Booster" logo when the ad appears in a results list and on the ad presentation page (except for the broadcast via the iPhone App)
- From the "Booster Pack" logo on the Personal Account Dashboard Listing
The Booster Pack is subscribed for a single Personal Account, from the dashboard of it, only from the Website.

It can be subscribed by an Advertiser with between 1 (one) and 200 (two hundred) Ads eligible for the Booster Pack on the Site. The Booster Pack cannot be subscribed beyond two hundred (200) Eligible ads shown simultaneously on the Site.p>

Ads eligible for the Booster Pack are all Ads on the Site, excluding those placed in one of the following categories "Real Estate Sales," "Rentals," "Colocations," "Holiday Rentals" or "Office and Commerce" ('Eligible Ads' »).

The Booster Pack is compatible with all other Paying Options, with the exception of "Modification" which is made unlimited and free for the duration of the Subscribed Booster Pack.

Any ad entered into a Booster Pack, once published by Annoncepopulaire, will be available on the Website and Applications.

The Booster Pack is subscribed for one (1) or three (3) months and a limited number of ads by the 4 tier (10, 50, 100 and 200 Ads) :

Booster Pack 1 (one) month:
- Booster Pack 1 to 10 ads
- Booster Pack 11 to 50 ads
- Booster Pack 51 to 100 ads
- Booster Pack 101 to 200 ads

Booster Pack 3 (three) months :
- Booster Pack 1 to 10 ads
- Pack Booster 11 à 50 annonces
- Pack Booster 51 à 100 annonces
- Pack Booster 101 à 200 annonces

The Advertiser chooses the duration of the Booster Pack. On the other hand, the Palier will be offered by the Site based on the number of Eligible Ads broadcast on the Site on the day of the subscription of this Paid Option.
Examples :
- If on the day of subscription to the Booster Pack, the Advertiser has 15 eligible ads running on the site, it will be offered only a Booster pack 11 to 50 ads for a duration of 1 (one) or 3 (three) months to choose.
- If on the day of subscription to the Booster Pack, the Advertiser with 99 Eligible ads running on the site, he will be offered a Booster pack 51 to 100 ads for a duration of 1 (one) or 3 (three) months to choose.
- If, as in the example, on the day of the subscription, the number of Eligible Ads shown on the Site is less than the maximum number of Ads that the Booster Pack can contain, the Advertiser will be able, until reaching that number, to bring its future Eligible Ads into its Booster Pack.
Once the maximum number of Eligible Ads has been reached in the Subscribed Booster Pack (i.e., 10, 50, 100 or 200), it is no longer possible to bring a new ad into the Booster Pack.

On the other hand, the expiration and deletion, by the Advertiser or by Annoncepopulaire , an Announcement of the Booster Pack, automatically entails, within a maximum of 24 hours, the entry of a new Eligible Ad in the Booster Pack. The entry of new Eligible Ad into the Booster Pack is in chronological order of the deposit.

At the expiration of the Booster Pack:
- The "Booster Pack" logo affixed to the ad disappears from all the pages where it was present (Ad presentation page, results list page and dashboard page)
- Unlimited free changes are disabled
- Top-of-the-list lifts every 2 weeks are disabled
- an expiry email is sent to the Advertiser who has subscribed to this option

Removing an ad from the Booster Pack does not cause the Pack to expire on other ads in the account.
The expiration of the Booster Pack does not result in the removal of Eligible Ads entered into this Pack.
Removing the Personal Account results in the immediate expiration of the Booster Pack and Ads.

6. price

The rates applied are those in effect on the day of the purchase of one or more paid options or an offer of credits by the Advertiser. Annoncepopulaire reserves the possibility of changing its prices at any time.

6.1 Paid options

The price of each paid option varies depending on the type of option subscribed and the deposit category selected.

6.2 Buying credits

There are five credit offers (1 credit – 1£ TTC) :
- Offer 1: €10 TTC - 10 credits ;
- Offer 2: €25 TTC - 25 credits ;
- Offer 3: €50 TTC - 50 credits ;
- Offer 4: €100 TTC - 105 credits (plus 5 credits offered) ;
- Offer 5: €150 TTC - 160 credits (10 credits offered).

7. PAYMENT AND BILLING

7.1 Paid options

Subscribe to one or more paid options can be done by any Advertiser connected to their Personal Account :
- credit card from the Website and Applications ;
- credits from the Website and Applications. If the credit balance is insufficient, the Advertiser can supplement its payment with a credit card payment.

Payment is due when each paid option is subscribed.

Any subscription of a paid option by credit card will result in an invoice sent to the email address indicated by the Advertiser when filing its Advertisement.

Any subscription of a paid option by credits will result in the sending of a proof to the email address indicated by the Advertiser when creating its Personal Account.

Any subscription of a paid option by credit and credit card will result in the sending of two emails: a first invoice e-mail corresponding to the payment by credit card and a second email including a proof of purchase of credits.

Invoices and vouchers will appear in the Personal Account.

The Advertiser, from the "My Purchases" tab, has the option to download, in PDF format, its invoices and vouchers relating to the subscription of paid options.

7.2 Buying credits

The purchase of credits is done by credit card only, by any Advertiser connected to his Personal Account.
The credit purchase history will be viewable from the Personal Account.

The Advertiser, from the "My Purchases" tab, has the option to download, in PDF format, its invoices relating to the purchase of credits.

7.3 Repayment and retraction

7.3.1 repayment

Credits are non-refundable.

Paid options are non-refundable.

If ad is removed

If an ad is refused by Annoncepopulaire due to its non-compliance aux Service broadcast rules Annoncepopulaire:
- The amount of the paid option (s) subscribed when filing or amending the Advertisement will not be deducted and an email will be sent to the Advertiser informing them that their Advertisement has been declined by Annoncepopulaire and won't be broadcast ;
- Credits used to pay for the amount of the paid option or options will not be deducted from the Advertiser's Personal Account ;
- In the case of a payment of the paid option (s) by credit and bank card, the sums paid will be returned in the form of credits, which the Advertiser recognizes and accepts.

On the other hand, if Annoncepopulaire was forced to remove the Advertisement being broadcast because of its non-compliance with the Service's broadcast rules and in part because its content was legitimately reported as abusive, Annoncepopulaire will not refund to the Advertiser the credits and/or the amount of the paid option or options underwritten when filing or changing the ad that was deleted during the broadcast.

If a Personal Account is deleted

The deletion of a Personal Account results in the removal of all attached Ads, and as a result, the removal of all paid options for these Ads and does not entitle you to any refund or compensation, which the Advertiser recognizes and accepts..

The deletion of a Personal Account results in the removal of associated credits, not having any right to refund, which the Advertiser recognizes and accepts.

7.3.2 retraction

Under Article L 121-21 of the Consumer Code, the Advertiser has 14 (14) free days to withdraw. However, in validating the order, the Advertiser accepts that Annoncepopulaire begins to perform the benefit and expressly waives his right of retraction.

8. RESPONSIBILITY, MAJOR FORCE

Responsibility for Annoncepopulaire may not be incurred in the event of non-performance or poor execution of the order due, either by the Advertiser or by a case of force majeure.

9. CHANGES TO CGVS

Annoncepopulaire reserves the possibility, at any time, to modify all or part of the GVCs.

Advertisers are encouraged to consult with GVCs on a regular basis to see the changes.

10. VARIOUS PROVISIONS

Should a portion of the GVCs prove to be unlawful, invalid or unenforceable, for any reason, the provisions in question would be deemed unwritten, without questioning the validity of the other provisions that will continue to apply between Advertisers and Annoncepopulaire, unless it was an impulsive and determinative clause that led one of the Parties to subscribe to the Paid Option.

Any complaint must be directed to the Customer Service Annoncepopulaire.

CGVs are subject to French law.
